These Terms of Service ("Terms") govern your use of this site and your request for a Free Workflow Audit for First Responder, a custom lead-response service built by Kaiflux ("Kaiflux," "we," "us"). By using this site, you agree to these Terms.
This site describes First Responder and offers a Free Workflow Audit: a 30-minute consultation to review your actual lead flow. Requesting an audit costs nothing and creates no obligation to purchase anything. If we determine there's a fit, we'll send you a custom proposal with real pricing for building your own First Responder system.
Submitting the request form does not create a contract for any paid service. It's a request for a conversation. Either side can decide not to proceed after the audit, with no cost or obligation to you.
If you choose to move forward after your audit, the scope, price, timeline, and terms (including any refund or cancellation terms) for your specific First Responder build are set out in your custom proposal, since every engagement is scoped to your own lead sources and workflow. Those proposal terms, not this page, govern a paid engagement once you accept one.
You must be at least 18 years old and requesting this consultation for legitimate real estate business purposes.
The consultation request form is provided by Google Forms and is subject to Google's own terms in addition to these.
A First Responder build may include automated SMS or email replies to leads that contact you. You are solely responsible for obtaining and maintaining valid consent from every person who receives a message sent through a system we build for you, and for compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and auto-dialer statutes, Do Not Call rules, and your carrier's messaging policies.
Kaiflux configures the system to your instructions and your lead sources. Kaiflux does not supply your contact lists, does not verify that consent was obtained, and is not the sender of record for messages sent from your accounts, your phone numbers, or your CRM. You are responsible for including required opt-out language, honoring opt-out requests promptly, and maintaining records of consent.
Kaiflux is not liable for claims, penalties, or damages arising from messages you send or authorize, including statutory damages under the TCPA.
Kaiflux provides automation build and consulting services, not legal advice. Nothing on this site, in an audit, or in any deliverable constitutes legal advice, and no attorney-client relationship is created.
Automated messaging, lead handling, and real estate advertising are regulated, and the rules differ by state and change over time. Confirm your consent process, message content, and disclosure requirements with your broker and with your own attorney before going live. Only a licensed attorney in your jurisdiction can advise you on your specific situation.
This site and the Free Workflow Audit are provided "as is." To the maximum extent permitted by law, Kaiflux is not liable for indirect, incidental, or consequential damages arising from your use of this site or the audit process.
We may update these Terms from time to time. Material changes will be reflected by an updated effective date above.
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles, unless a mandatory law of your own country of residence requires otherwise.
